Terms, privacy, and the fine print.

These terms govern your use of The Tox Pass®, TrueTox®, True Collective™, our websites, mobile and web applications, telehealth services, and any products or membership offerings (collectively, the “Services”). Please read carefully — by using the Services you agree to these terms.

01 — Overview

The Tox Pass®, TrueTox®, TrueLips®, TrueLip Flip®, and True Collective™ (together, the “Brand”) are operated by True Aesthetics, Inc. (“we,” “us,” or “our”). We are a technology and membership platform that connects members with independent, board-certified medical providers (“True Providers”) for aesthetic, wellness, and longevity care delivered in-person at participating clinics or via licensed telehealth providers.

We are not a medical practice. We do not practice medicine, prescribe, dispense, or compound medications, and we do not establish a provider–patient relationship. All clinical decisions, diagnoses, prescriptions, and procedures are the sole responsibility of the licensed provider you engage through the Services.

02 — Terms of Service

By creating an account, booking a visit, purchasing a product, or otherwise using the Services, you represent that you are at least 18 years old, legally able to enter into a binding contract, and reside in a U.S. state where the applicable Service is offered. You agree to provide accurate information, keep your account credentials confidential, and use the Services only for lawful purposes.

We may update these terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Services after the effective date constitutes acceptance of the updated terms.

03 — Membership & Billing

Initial term. TrueTox® requires a six (6) month initial commitment. After the initial term, membership renews month-to-month and may be canceled at any time with no fees through the member portal. Wellness, Longevity, and bundled cadence plans may carry their own initial terms disclosed at checkout.

Billing. Membership fees are billed monthly in advance to the payment method on file. All fees are in U.S. dollars and exclude applicable taxes. Failed payments may result in suspension of benefits until the balance is current.

Pauses & refunds. Members may request one pause per calendar year. Refunds are not issued for prior months, unused visits, or shipped product. Promotional or introductory rates are non-transferable.

Cancellation. After the initial term, cancel anytime through the member portal. Cancellation takes effect at the end of the current billing cycle.

04 — Telehealth Informed Consent

The Services include access to virtual visits with licensed medical providers (“Telehealth Visits”) for eligibility review, lifestyle and wellness consultation, and ongoing care management where clinically appropriate.

By booking a Telehealth Visit, you acknowledge and consent that: (a) telehealth involves the use of secure audio, video, and messaging technology in lieu of an in-person encounter; (b) the same standards of care, confidentiality, and recordkeeping apply; (c) certain conditions may not be appropriate for telehealth and your provider may direct you to in-person care; (d) technical failures may interrupt a visit and require rescheduling; and (e) you have the right to withhold or withdraw consent at any time without affecting your right to future care.

Telehealth services are delivered only in states where the assigned provider is licensed. You must be physically located in such a state at the time of the visit. We do not guarantee any specific clinical outcome, prescription, or therapy.

05 — Shop, Shipping & Returns

Eligibility-gated products. Certain shop items — including compounded GLP-1 therapy, GLP-1/GIP therapy, peptide therapy, and recovery peptides — are prescription products that require an eligibility review and prescription from a licensed provider before fulfillment. Pricing for these products is shown only after eligibility review and is not a public offer.

Non-prescription products. Skincare, supplements, and merchandise may be purchased directly. Orders are typically processed within 2–3 business days and shipped via tracked carriers. Risk of loss passes to you upon delivery to the carrier.

Returns. For health and safety reasons, prescription medications, compounded therapies, opened skincare, and opened supplements are non-returnable and non-refundable. Sealed, unopened non-prescription items may be returned within 14 days of delivery for store credit, less shipping. Defective or damaged items will be replaced at our cost — contact support@thetoxpass.com within 7 days of delivery with photos.

Pricing & taxes. Prices are subject to change without notice. Sales tax is calculated at checkout based on shipping address.

06 — Compounded Therapies

Compounded medications offered through the Services are prepared by licensed 503A or 503B compounding pharmacies pursuant to a valid prescription from a licensed provider, based on an individualized clinical assessment. Compounded medications are not FDA-approved drug products; the FDA does not review compounded preparations for safety, effectiveness, or quality before they are marketed.

By electing to receive a compounded therapy, you acknowledge the foregoing and confirm that your provider has discussed the risks, benefits, alternatives, and expected use with you. Therapies are designed to support your individualized plan and may not be appropriate for every person. Always follow your provider’s instructions and consult your provider before making changes to any prescribed regimen.

07 — Provider Terms

True Providers are independent, board-certified medical professionals who operate their own practices and are solely responsible for clinical care, prescribing, documentation, and supervision of their staff. We provide the technology, brand standards, and operational support that connect members with providers; we do not direct or control clinical judgment.

Providers in the network are vetted, licensed, and MD-supervised in accordance with applicable state law. Members may switch providers within network rules; the recommended cadence is to build a long-term, one-to-one relationship with a single True Provider.

08 — True Collective™

True Collective™ is our independent-clinic membership program providing back-office, marketing, and operational tooling to participating practices. Members of True Collective™ remain independent businesses and are solely responsible for their clinical care, employment, tax, and regulatory compliance. Specific obligations are governed by the True Collective™ Participating Provider Agreement executed at onboarding.

09 — Privacy Policy

We collect information you provide (name, contact details, payment information, intake responses), information collected automatically (device, log, cookie, and analytics data), and information from your provider (visit summaries, prescriptions, lab results) as needed to deliver the Services.

We use this information to operate the Services, communicate with you, process payments, comply with law, and improve the platform. We do not sell personal information. We do not share your protected health information for third-party advertising. We share data only with: (a) your assigned provider and pharmacy; (b) service providers under contract (payment processors, cloud hosting, analytics); and (c) authorities when required by law.

You may request access to, correction of, or deletion of your personal data, subject to legal and clinical recordkeeping obligations. Contact privacy@thetoxpass.com.

10 — HIPAA Notice of Privacy Practices

Where we operate as a Business Associate or directly handle Protected Health Information (PHI), we maintain administrative, physical, and technical safeguards required under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the HITECH Act. PHI is used and disclosed only as permitted by law, your authorization, or for treatment, payment, and healthcare operations.

You have the right to inspect, copy, amend, and request restrictions on the use of your PHI, and to receive an accounting of disclosures. To exercise these rights or to file a privacy complaint, contact privacy@thetoxpass.com.

11 — Cookies & Tracking

We use cookies and similar technologies to remember preferences, secure sessions, measure performance, and improve the Services. You may control cookies through your browser settings; disabling cookies may impact certain features. We do not use cross-site advertising trackers on logged-in member experiences.

12 — Intellectual Property

The Tox Pass®, TrueTox®, TrueLips®, TrueLip Flip®, True Provider™, True Collective™, the “true.” wordmark, the cadence dot, and all related logos, trade dress, content, and software are the property of True Aesthetics, Inc. and protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

13 — Medical Disclaimers & Limitation of Liability

The content on our websites, blog, social channels, and in-app communications is for general informational purposes only and is not medical advice. Always consult your provider before starting, changing, or stopping any therapy. Individual results vary. No outcome is guaranteed.

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim all warranties, express or implied. Our aggregate liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim or (b) one hundred U.S. dollars ($100).

14 — Arbitration & Dispute Resolution

Any dispute arising out of or relating to these terms or the Services will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in New York, NY, in English, before a single arbitrator. You and we each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement within thirty (30) days of first accepting these terms by emailing legal@thetoxpass.com with the subject line “Arbitration Opt-Out.” These terms are governed by the laws of the State of Delaware without regard to conflict-of-laws principles.

These terms supersede any prior versions. Capitalized terms not defined here have the meanings given in the applicable enrollment, telehealth consent, or product-specific agreement. Nothing in these terms limits any right you have under applicable law that cannot be waived by contract.
